The fact that the data mining payout is increased in this area leads me to believe that there will be a tradeoff: namely that you are attackable by everyone in the construct. I would imagine it's a balancing measure to keep 50 people from sitting in there data mining together. You have to find a good hiding place if you want to camp and data mine (or a good team protecting you... a team you can trust ) or else you'll have to fight to stay in there.
Plus... I remember making a post a long time ago where I prophesized that a new area open to all levels would suck everyone out of the city and then all our new players would really think MxO's a ghost town. The FFA construct area would prevent people from idling AFK in the new area just for fun.
Lastly, from my experience with the FFA areas during the Joker Finale, being flagged FFA makes you immediately attackable by everyone, regardless of your level. I imagine that's how this construct will be.
